General Terms and Conditions for the Purchase of Online Vouchers

1) General:
The contract is concluded with Österreichische Bergbahnen GmbH. Any deviating provisions are only valid if they have been expressly agreed in writing by both parties.
Only persons over the age of 18 are authorised to make purchases in our Internet shop.

2) Conclusion of Contract, Payment and Delivery:
The vouchers offered on the cable car website represent a non-binding and non-binding offer to purchase. The prices quoted are inclusive of any statutory VAT. The online order of a voucher via the Internet constitutes a binding purchase offer by the customer, which Österreichische Bergbahnen GmbH is entitled to accept within 48 hours by means of an order confirmation via e-mail, whereby the purchase contract is concluded. If no order confirmation is received within the aforementioned period, the purchase offer is deemed to have been rejected and no purchase contract is concluded. The purchased vouchers will be dispatched by Österreichische Bergbahnen GmbH after receipt of the payment owed on the basis of the concluded purchase contract. In order to save shipping costs, the purchased vouchers can also be paid for by credit card or bank transfer, in which case the vouchers can be sent free of charge by e-mail and printed out by the customer. If requested by the customer, the vouchers will also be sent by post if they are paid for by credit card or bank transfer. No liability is accepted for any delay in delivery by post. If the voucher ordered online has already been sent to the customer before the payment to be made for it has been received or credited by Österreichische Bergbahnen GmbH. has been received or credited, the voucher shall not be valid until full payment has been made and Österreichische Bergbahnen GmbH. shall be entitled to withhold the services securitised in the voucher until full payment of the fee owed for them has been made.

3) Vouchers
In the case of online vouchers, please note that these are sent to the customer by Österreichische Bergbahnen GmbH with a forgery-proof code. As the customer can print out the voucher themselves, several prints are possible, but only one print is relevant in terms of value and can be redeemed. The first voucher redeemed in the INCERT voucher management system with the corresponding barcode is regarded as the original and must be debited by Österreichische Bergbahnen GmbH immediately after redemption. Should further copies with the same code appear, this constitutes misuse, which will result in criminal prosecution. As a voucher can be passed on or given as a gift, Österreichische Bergbahnen GmbH is not obliged or able to check the right of ownership of the redeemer. When the voucher is redeemed, it is only checked whether the corresponding barcode has actually been authorised by the system and whether the corresponding voucher has actually been paid for.
Lost vouchers will not be replaced. Vouchers can also not be returned for cash value. If the value of the voucher is more than the service consumed, a new voucher will be generated with the remaining value. In such a case, there is no entitlement to a cash payment of the outstanding voucher amount.
Österreichische Bergbahnen GmbH. is not obliged to accept unpaid vouchers as a means of payment. For operational reasons, the services listed in the voucher can only be provided or guaranteed by the company if a corresponding and timely reservation has been made. The service described in the voucher may vary slightly depending on the circumstances, but must not represent a relevant reduction in value for the guest. Should Österreichische Bergbahnen GmbH. have to close or give up for any reason, the online vouchers expire without compensation. This is also the case if the business demonstrably changes ownership. In that case, Österreichische Bergbahnen GmbH cannot be held liable as the original issuer of the vouchers.

4) Validity, Period of Validity:
Vouchers have no expiry date and can be redeemed at any time. All other vouchers are redeemable upon prior request and availability and are valid for one year from the date of issue stated on the voucher. Each voucher can only be redeemed once, which is ensured by a barcode or voucher number linked to the voucher.

5) Cash Redemption, Invoicing:
Cash redemption of the voucher or the value securitised by is not possible. A VAT-compliant invoice with corresponding proof of tax can only be issued at the time of redemption of the voucher and thus the actual provision of the service.

6) Security Guarantee, Data Protection:
Your security is our top priority! For this reason, data such as credit card number, sort code, account number, name and address are transmitted via certified payment providers using their protected SSL line in accordance with PCI guidelines. This means that no unauthorised person can read the data you enter during transmission over the Internet. In order to ensure additional security in the voucher shop, we apply a number of additional security measures. Your details are processed automatically by us. On the basis of the general terms and conditions, the customer agrees to receive advertising information from Österreichische Bergbahnen GmbH. This data will not be passed on to third parties.

7) Exchange, Right of Cancellation:
Please return vouchers that do not meet your expectations within 14 days of sending them to us. It is necessary that the written cancellation (revocation) declaration is received by Österreichische Bergbahnen GmbH within 14 days. However, the right of cancellation does not apply if the use of the service has already begun within the cancellation period. This right of cancellation only applies to customers who qualify as consumers. In the event of loss, theft or cancellation of vouchers, Österreichische Bergbahnen GmbH cannot provide any compensation.
8) Place of Jurisdiction:
Austrian law shall apply exclusively to all contractual relationships.
The place of jurisdiction is the Regional Court of Wr. Neustadt, Austria.
